１．定義
１）個人情報取扱事業者：

ｅ．正規販売店：当社と販売店契約を締結し、それに基づいてメルセデス・ベンツ製品（メルセデス・ベンツ社が製造又は販売する製品をいいます。以下同じ。）の販売を行う法人
ｆ．認定部品商：当社とメルセデス・ベンツ認定部品商契約を締結し、それに基づいてメルセデス・ベンツ製品の部品の販売を行う法人又は個人
２）個人情報：
個人情報の保護に関する法律（以下「個人情報保護法」という）第2条第1項に規定する個人情報をいいます。すなわち、生存する個人に関する情報であり、次のいずれかに該当するものを指します。
・特定の個人を識別することができるもの、又は他の情報と容易に照合することができ、それにより特定の個人を識別することができるもの。
・個人識別符号が含まれるもの。
３）要配慮個人情報：
本人の人種、信条、社会的身分、病歴、犯罪の経歴、犯罪により害を被った事実その他本人に対する不当な差別、偏見その他の不利益が生じないようにその取扱いに特に配慮を要するものとして政令で定める記述等が含まれる個人情報です。
４）個人データ：
個人情報データベース等を構成する個人情報のことです。 個人情報データベース等とは、特定の個人情報を検索できるように体系的にまとめられたものを指します。
５）保有個人データ：
個人情報取扱事業者が、開示、内容の訂正、追加又は削除、利用の停止、消去及び第三者への提供の停止を行うことのできる権限を有する個人データを指します。ただし、その存否が明らかになることにより公益その他の利益が害されるものとして政令で定めるものは該当しません。
６）クッキー：
技術的には、HTMLクッキーと、Web/DOMストレージやローカル共有オブジェクト等の類似のソフトウェアツール（いわゆる「Flashクッキー」）があり、当社はこれらをまとめてクッキーと呼びます。
２．個人情報の保護
当社は、当社が管理するお客さまの情報を、改ざん、紛失、破棄又は不正アクセスから保護するために、技術的・組織的なセキュリティ対策を講じます。当社は、技術の進歩に伴い、セキュリティ対策を継続的に改善しています。
３．お客さまによる選択
お客さまには、法的にも契約上も、お客さまの個人情報を提供していただく義務はありません。ただし、当社のウェブサイトの一部の機能は、個人情報の提供を条件としてご利用いただく場合があります。もしお客さまから個人情報が提供されない場合はお客さまが、それらの機能を利用できない、また機能を制限された状態でご利用いただくことになる可能性があります。
４．個人情報の利用目的
お客さまからご提供いただいた個人情報を次に定める利用目的の範囲内で利用します。
１）お客さまからのご要望やお問合せにお応えするため

４）取得した情報を利用又は分析等(AIによる分析を含む)して当社の自動車販売事業及び自動車ローンやリース等の付随サービスに関するフェア、商品・サービス情報、イベント等についての印刷物の送付、電話、電子メール、SNS（ソーシャルネットワーキングサービス）、SMS（ショートメッセージサービス）、訪問、DM、Web広告、当社製品・サービスの機能及び当社に関する情報誌発送等によるご案内を行うため
５）当社の自動車販売事業及び付随サービスに関する商品・サービスの企画・開発、消費者動向調査、顧客満足度調査等のマーケティング活動のためのアンケート調査を行うため
６）取得した情報を利用又は分析等(AIによる分析を含む)して当社の定期点検、車検・保険満期等のアフターサービスに関する印刷物の送付、電話、電子メール、SNS（ソーシャルネットワーキングサービス）、SMS（ショートメッセージサービス）、訪問、DM、Web広告、当社製品・サービスの機能及び当社に関するご案内を行うため
７）当社の社内統計資料作成のため（年齢構成、性別構成等）
８）お客さまの利便性の確保及び当社のITシステムを攻撃やその他の不正行為から保護するため
９）前各号に付随する目的で利用するため
５．取得する個人情報の内容
１）お客さまが当社のウェブサイトにアクセスされたときは、その都度、当社は以下の情報を取得し、保存いたします。
・ブラウザとオペレーティングシステムに関する特定の情報
・アクセス日時
・インタラクションのステータス（例：ウェブサイトにアクセスできたか、あるいはエラーメッセージを受け取ったか）
・ウェブサイト上の機能の利用
・入力した検索フレーズ
・個々のウェブサイトのアクセス頻度
・アクセスしたファイルの名前
・転送されたデータの量
・ウェブサイトへのアクセス元となったウェブページ
・ウェブサイトの訪問後に（当社のウェブサイト上のリンクをクリックすることによって、又は当社のウェブサイトが開いているのと同じブラウザのタブ（又はウィンドウ）の入力フィールドにドメインを直接入力することによって）アクセスしたウェブページ
２）その他の個人情報
その他の個人情報については、登録、連絡先フォーム、チャット、調査、価格競争の一部として、若しくは、契約の締結又は当社がお客さまに商品やサービスを提供するために、お客さまから提供された場合等に、当社はこれを取得し、保存します。
６．要配慮個人情報の取扱い
当社は、要配慮個人情報については、法令等に基づき許容される場合を除くほか、あらかじめ本人の同意を得ることなく取得を行いません。

８．第三者への開示・提供及び業務の委託
当社は、次に定める場合にお客さまの個人データを提供させていただくことがあります。
１）当社は、EU加盟国及びイギリスの他に、アメリカ、メキシコ、インド、シンガポール、フィリピン、マレーシア、その他の外国にある関係会社およびサーバー管理会社等の委託先（当社より業務の委託を受けた第三者をいいます。以下同じ。）にお客さまの個人データを提供します。
ａ．提供先国の制度：個人情報保護委員会の公表資料へのリンク
ｂ．提供先における安全管理措置：当社は、外国の提供先との間で、個人情報保護法第4章第1節及び第2節の規定の趣旨に沿った措置を外国の提供先が講ずることを義務付けた契約を締結した上で、個人情報を提供しています。当該契約において、外国の提供先は、特定した利用目的の範囲内で個人データを取り扱う旨、必要かつ適切な安全管理措置を講ずる旨、個人データの第三者提供の禁止等を定めています。
２）当社は、本条１）のほか、セクション４に定める利用目的の達成に必要な範囲内で、委託先に、個人データの取扱いを委託します。尚、委託先は、委託された業務以外に当該個人データを使用しないものとします。
３）当社は、セクション４に定める利用目的を達成するために必要がある場合に、同利用目的の範囲で利用するために、お客さまの個人データを、次の第三者提供先に提供します。第三者提供先はこちらからご確認ください。
４）当社は、セクション７に定める共同利用の場合および本条１）２）３）に定める場合を除き、お客さまの個人データを、事前にお客さまの同意を得ることなく、第三者に提供しません。但し、人の生命、身体または財産の保護に必要がある場合であって、お客さまの同意を得ることが困難であるときなど、国内外の法令に基づき許容される場合には、お客さまの同意を得ずに、個人データの第三者提供を行うことがあります。
９．個人情報の取り扱いに関する開示等請求
お客さまが、当社に対して、個人情報保護法に基づき、当社の保有個人データの開示・利用目的通知・訂正・利用停止等をご請求の場合は、 当社所定の書式（下記ご参照）をご使用の上、当社まで必要書類と共に送付してください。なお、開示および利用目的通知請求につきましては、下記所定用紙に記載の手数料を事前にお支払いただきますので、予めご了承ください。また、開示のご請求については、原則として、電磁的記録の提供の方法により開示いたします。

１０．クッキー

8．クッキー（Cookie）の使用について
Cookieの使用に関する方針
当社は、当社のウェブサイトを利用するユーザーの興味関心や、特に人気のある分野を把握し、これらの情報に基づいて、ウェブサイトのデザインを改良し、利便性をさらに向上させるために、Cookieおよび、HTML5ストレージまたはLocal Shared Objectのような類似のソフトウェアツールを使用します（合わせて「Cookie」と呼びます）。
1. Cookieの機能と用途

例えばFacebook、TwitterおよびGoogle+といったソーシャルネットワークや、当社のターゲティングおよびリターゲティングパートナーなど、第三者が設定するCookieです。ユーザーはソーシャルネットワークの内容を、当社のウェブサイトで提供している「ソーシャルプラグイン」で組み込むことができます。また、ターゲティングおよびリターゲティングパートナーの助けにより、当社のオンラインマーケティングをユーザーの需要や興味に的確に合わせることができます。

１．定義
１）個人情報取扱事業者：
ａ．当社：メルセデス・ベンツ日本合同会社
ｂ．メルセデス・ベンツ社：Mercedes-Benz AG
ｃ．メルセデス・ベンツ グループ社：Mercedes-Benz Group AG
ｄ．メルセデス・ベンツ グループ会社：メルセデス・ベンツ社並びにメルセデス・ベンツ社の親会社・子会社及び関係会社
ｅ．正規販売店：当社と販売店契約を締結し、それに基づいてメルセデス・ベンツ製品（メルセデス・ベンツ社が製造又は販売する製品をいいます。以下同じ。）の販売を行う法人
ｆ．認定部品商：当社とメルセデス・ベンツ認定部品商契約を締結し、それに基づいてメルセデス・ベンツ製品の部品の販売を行う法人又は個人
２）個人情報：
個人情報の保護に関する法律（以下「個人情報保護法」という）第2条第1項に規定する個人情報をいいます。すなわち、生存する個人に関する情報であり、次のいずれかに該当するものを指します。
・特定の個人を識別することができるもの、又は他の情報と容易に照合することができ、それにより特定の個人を識別することができるもの。
・個人識別符号が含まれるもの。
３）要配慮個人情報：
本人の人種、信条、社会的身分、病歴、犯罪の経歴、犯罪により害を被った事実その他本人に対する不当な差別、偏見その他の不利益が生じないようにその取扱いに特に配慮を要するものとして政令で定める記述等が含まれる個人情報です。
４）個人データ：
個人情報データベース等を構成する個人情報のことです。 個人情報データベース等とは、特定の個人情報を検索できるように体系的にまとめられたものを指します。
５）保有個人データ：
個人情報取扱事業者が、開示、内容の訂正、追加又は削除、利用の停止、消去及び第三者への提供の停止を行うことのできる権限を有する個人データを指します。ただし、その存否が明らかになることにより公益その他の利益が害されるものとして政令で定めるものは該当しません。
６）クッキー：
技術的には、HTMLクッキーと、Web/DOMストレージやローカル共有オブジェクト等の類似のソフトウェアツール（いわゆる「Flashクッキー」）があり、当社はこれらをまとめてクッキーと呼びます。
２．個人情報の保護
当社は、当社が管理する取引先の情報を、改ざん、紛失、破棄又は不正アクセスから保護するために、技術的・組織的なセキュリティ対策を講じます。当社は、技術の進歩に伴い、セキュリティ対策を継続的に改善しています。
３．取引先による選択
取引先には、法的にも契約上も、取引先の個人情報を提供していただく義務はありません。ただし、当社のウェブサイトの一部の機能は、個人情報の提供を条件としてご利用いただく場合があります。もし取引先から個人情報が提供されない場合は取引先が、それらの機能を利用できない、また機能を制限された状態でご利用いただくことになる可能性があります。
４．個人情報の利用目的
取引先からご提供いただいた個人情報を次に定める利用目的の範囲内で利用します。
１）取引先からのご要望やお問合せにお応えするため
２）当社と取引先とのお取引を円滑に実施するため
３）取引先情報を統計処理し、分析（AI による分析を含みます。）することで、取引先との取引を円滑化し、若しくは利便性を向上させるため、又はシステム若しくはサービスを提供するため
４）取引先に対するイベント等の開催をするに当たり、参加者の把握及びイベント等の運営実施のため
５）当社がお客さまに対し下記を実施するに当たって、取引先を通じて円滑なご案内を行うため
(ア) 当社の自動車販売事業及び付随サービスに関する商品・サービスの企画・開発、消費者動向調査、顧客満足度調査等のマーケティング活動のためのアンケート調査又はイベント等の開催
(イ) 当社の自動車販売事業及び自動車ローンやリース等の付随サービスに関するフェア、商品・サービス情報、イベント等についての印刷物の送付、電話、電子メール、SNS（ソーシャルネットワーキングサービス）、SMS（ショートメッセージサービス）、訪問、DM、Web広告、当社製品・サービスの機能及び当社に関する情報誌発送等によるご案内
(ウ) 当社の定期点検、車検・保険満期等のアフターサービスに関する印刷物の送付、電話、電子メール、SNS（ソーシャルネットワーキングサービス）、SMS（ショートメッセージサービス）、訪問、DM、Web広告、当社製品・サービスの機能及び当社に関するご案内
６）当社の社内統計資料作成のため（年齢構成、性別構成等）
７）取引先の利便性の確保及び当社のITシステムを攻撃やその他の不正行為から保護するため
８）前各号に付随する目的で利用するため
５．取得する個人情報の内容
１）取引先が当社のウェブサイトにアクセスされたときは、その都度、当社は以下の情報を取得し、保存いたします。
・ブラウザとオペレーティングシステムに関する特定の情報
・アクセス日時
・インタラクションのステータス（例：ウェブサイトにアクセスできたか、あるいはエラーメッセージを受け取ったか）
・ウェブサイト上の機能の利用
・入力した検索フレーズ
・個々のウェブサイトのアクセス頻度
・アクセスしたファイルの名前
・転送されたデータの量
・ウェブサイトへのアクセス元となったウェブページ
・ウェブサイトの訪問後に（当社のウェブサイト上のリンクをクリックすることによって、又は当社のウェブサイトが開いているのと同じブラウザのタブ（又はウィンドウ）の入力フィールドにドメインを直接入力することによって）アクセスしたウェブページ
２）その他の個人情報
その他の個人情報については、登録、連絡先フォーム、チャット、調査、価格競争の一部として、若しくは、契約の締結又は当社が取引先に商品やサービスを提供するために、取引先から提供された場合等に、当社はこれを取得し、保存します。
６．要配慮個人情報の取扱い
当社は、要配慮個人情報については、法令等に基づき許容される場合を除くほか、あらかじめ本人の同意を得ることなく取得を行いません。

８．第三者への開示・提供及び業務の委託
当社は、次に定める場合に、取引先の個人データを提供させていただくことがあります。
１）当社は、EU加盟国及びイギリスの他に、アメリカ、メキシコ、インド、シンガポール、フィリピン、マレーシア、その他の外国にある関係会社およびサーバー管理会社等の委託先（当社より業務の委託を受けた第三者をいいます。以下同じ。）に取引先の個人データを提供します。
ａ．提供先国の制度：個人情報保護委員会の公表資料へのリンク
ｂ．提供先における安全管理措置：当社は、外国の提供先との間で、個人情報保護法第4章第1節及び第2節の規定の趣旨に沿った措置を外国の提供先が講ずることを義務付けた契約を締結した上で、個人情報を提供しています。当該契約において、外国の提供先は、特定した利用目的の範囲内で個人データを取り扱う旨、必要かつ適切な安全管理措置を講ずる旨、個人データの第三者提供の禁止等を定めています。
２）当社は、本条１）のほか、セクション４に定める利用目的の達成に必要な範囲内で、委託先に、個人データの取扱いを委託します。尚、委託先は、委託された業務以外に当該個人データを使用しないものとします。
３）当社は、セクション４に定める利用目的を達成するために必要がある場合に、同利用目的の範囲で利用するために、取引先の個人データを、次の第三者提供先に提供します。第三者提供先はこちらからご確認ください。
４）当社は、セクション７に定める共同利用の場合および本条１）２）３）に定める場合を除き、取引先の個人データを、事前に取引先の同意を得ることなく、第三者に提供しません。但し、人の生命、身体または財産の保護に必要がある場合であって、取引先の同意を得ることが困難であるときなど、国内外の法令に基づき許容される場合には、取引先の同意を得ずに、個人データの第三者提供を行うことがあります。
９．個人情報の取り扱いに関する開示等請求
取引先が、当社に対して、個人情報保護法に基づき、当社の保有個人データの開示・利用目的通知・訂正・利用停止等をご請求の場合は、 当社所定の書式（下記ご参照）をご使用の上、当社まで必要書類と共に送付してください。なお、開示および利用目的通知請求につきましては、下記所定用紙に記載の手数料を事前にお支払いただきますので、予めご了承ください。また、開示のご請求については、原則として、電磁的記録の提供の方法により開示いたします。

１０．クッキー
取引先が当社のウェブサイトをご覧になる際クッキーが使用される場合があります。
１）クッキーは、取引先がウェブサイトにアクセスしている間、取引先のデスクトップ、ノートPC、又はモバイルデバイスに保存される小さなファイルです。クッキーを使用することで、例えば、デバイスとウェブサイトの間に既に接続があるかどうかを確認したり、取引先のお好みの言語やその他の設定を考慮したり、特定の機能（例：オンラインショップ、車両コンフィギュレータ）を取引先に提供したり、取引先の利用に基づく興味を認識したりすることが可能になります。クッキーには個人情報が含まれる場合もあります。
２）取引先が当社のウェブサイトにアクセスする際に、クッキーが使用されるか否か、及びどのクッキーが使用されるかは、取引先が当社のウェブサイトのどの領域及び機能を使用するかにより、また、取引先が当社の同意管理システムにおいて、技術的に必要とされないクッキーの使用に同意されるか否かによります。クッキーの設定はこちら
３）クッキーの使用は、取引先がお使いのウェブブラウザの設定によっても異なります（例：Microsoft Edge、Google Chrome、Apple Safari、Mozilla Firefox）。ほとんどのウェブブラウザは、特定の種類のクッキーを自動的に受け入れるように事前設定されていますが、通常この設定は変更することができます。取引先は、保存されているクッキーをいつでも削除することができます。Web/DOMストレージとローカル共有オブジェクトは、個別に削除することができます。
４）クッキーに対する同意と拒否又は削除は、使用されるデバイスとウェブブラウザに関連付けられています。取引先が複数のデバイス又はウェブブラウザを使用される場合、それぞれについて異なる決定又は設定を行うことができます。
５）取引先がクッキーの不使用を決定したり、クッキーを削除したりした場合、当社のウェブサイトのすべての機能にはアクセスできなくなったり、個々の機能に制限が生じたりする場合があります。
１１．その他
１）メルセデス・ベンツ社のセントラル・レジストレーション・サービス
メルセデス・ベンツ社が提供する「セントラル・レジストレーション・サービス」により、取引先は、当該サービスに接続されているメルセデス・ベンツ グループ会社及びそのブランドに帰属するすべてのウェブサイト及びアプリケーションに登録することができます。適用される利用規約には、各ウェブサイト及びアプリケーションのデータ保護規定が含まれます。当該利用規約は、各ウェブサイト及びアプリケーションの登録ページ等で確認することができます。
